Police Make MIP Arrests on Square

A pair of Schuyler County teenagers is facing charges following their arrest on the Memphis City Square on Saturday evening.

According to the Memphis Police Department, a 16-year-old juvenile from Downing and Nevin R. Martin, 18, of Lancaster were ticketed for minor visibly intoxicated/in possession of alcohol.

According to court documents, the juvenile's blood alcohol content was 0.215. Martin's BAC was 0.04.

Under Missouri's revised minor in possession law, any person under the age of twenty-one years, who purchases or attempts to purchase, or has in his or her possession, any intoxicating liquor or who is visibly in an intoxicated condition, or has a detectable blood alcohol content of more than two-hundredths of one percent or more by weight of alcohol in such person's blood is guilty of a misdemeanor.

The first violation of this section is punishable by a fine not to exceed $300.

The law also designates that anyone under age 21 detained for minor in possession is deemed to have given consent for testing for the purpose of determining the alcohol or drug content of the person's blood.
